Hungary condemns critical Sargentini report of European Parliament

The Hungarian Parliament adopted a resolution here on Tuesday condemning the Sargentini report of the European Parliament, which triggered procedures under Article 7 against Hungary.

The Members of Parliament approved the resolution with a vote of 129 for, 26 against and 18 abstentions.

The procedures under Article 7 could ultimately strip Hungary of its EU voting rights, citing the "existence of a clear risk of a serious breach by Hungary of the values on which the Union is founded".

But in order to engage the sanctions, a unanimous vote is needed within the European Council of the heads of state or government of the EU, and Poland and Hungary have already declared on several occasions that they would never vote against one another.

On Oct. 15, the Hungarian Minister of Foreign Affairs and Trade Peter Szijjarto declared that "the Hungarian and Polish governments would not vote on any sanctions against one another during the procedures under Article 7 of the European Union (EU)."

The resolution, submitted to lawmakers by Mate Kocsis and Gergely Gulyas, members of the governing party Fidesz, stated that the Sargentini report "attacked the decisions taken by the democratically elected Parliament of Hungary".

Adopted on Sept. 12, the Sargentini report enumerated a number of concerns concerning the rule of law in Hungary, the changes to its electoral system without the approval of the opposition parties, the independence of the judiciary, namely the decrease of power of the Constitutional Court, corruption issues, freedom of expression, assembly and religion, as well as the rights of minorities and asylum-seekers.

The report has "exceeded its jurisdiction and violated Hungary's sovereignty," the resolution adopted Tuesday added.

"We reject the report because it attacks Hungary on the grounds that it did not take in migrants, refused to accept mandatory resettlement quotas, closed its border and criminalized the organization of illegal migration," the resolution detailed.

"Only the Hungarians may decide with whom they do or do not want to live," the resolution concluded.

Besides the resolution adopted Tuesday, the Hungarian government already took legal measures against the report, which had been adopted in a "fraudulent" manner, according to Budapest.

On Sept. 19, the Hungarian government declared it would be contesting the European Parliament vote on the Sargentini report at the European Court of Justice (ECJ), arguing that the vote condemning Hungary for the non respect of EU values had been conducted in an "irregular" manner.

"The government will be contesting the European Parliament vote on the Sargentini Report at the European Court of Justice in view of the fact that a two-thirds majority was achieved by ignoring the votes in abstention, in violation of the Treaty of Lisbon," according to the Hungarian government.
